ORDER
This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the online application submitted by the petitioner on 08.02.2025 and to conduct the survey in the subject property and demarcate the boundaries and issue separate patta in the name of the petitioner after subdividing the property.
2.Heard Mr.S.Elumalai, learned counsel appearing on behalf of the petitioner, Mr.S.Jayachandran, learned Government Advocate appearing on
3/6 behalf of respondents 1 & 2 and Mr.V.J.Priyadarsana, learned Government Advocate (Crl. Side) appearing on behalf of the 3 rd respondent.
3.The petitioner is relying upon the Settlement Deeds dated 11.08.2015 & 20.07.2016 executed by the father and by the 4 th respondent. The petitioner is also relying upon the joint patta issued in Patta No.2397 and 2550 dated 10.01.2025. The petitioner submitted an online application seeking for survey of the subject property. Since the same was not acted upon, the present writ petition has been filed before this Court.
4.Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 1 st respondent to act upon the application submitted by the petitioner on 08.02.2025 and conduct the survey in the subject property based on the title documents and the joint patta that stands in the name of the petitioner. The said process shall be completed, within a period of four weeks from the date of receipt of copy of this order. If there are any rival claims, such survey shall be conducted in their presence.
