This miscellaneous petition seeks set aside of order dated 16.04.2019, in terms of which, W.P.No.16503 of 2016 has been dismissed for default.

2. For the reason set out in the M.P. being the medical ailments of the then counsel who has since passed away and in light of the fair submissions of Mr.Rahul Kumar, learned counsel for Mr.Fayaz Ali, learned counsel for the respondents, who has no objections to set aside order dated 16.04.2019, this M.P. is ordered.

3. W.P.No.16503 of 2016 will be listed for hearing on 10.01.2023. Copy of the writ affidavit and annexures will be handed over to the learned counsel for the respondents forthwith, and in any event by tomorrow, to enable them to file their counter.

4. Final chance is granted for completion of pleadings on or before 09.01.2023 with copies served in advance upon the petitioner.
