(The case has been heard through video conference) Heard the learned counsel appearing for the appellants and the learned counsel for the respondent.
2. This Second Appeal is filed by the plaintiff in the suit being aggrieved by the reversing the judgment of the lower appellate Court pending since 2011. While so, on 12.02.2018, the parties have entered into compromise in the Lok Adalat Court conducted by the High Court Legal Services Committee, Chennai and pursuant to that Mr.V.Sridhar who is the defendant in O.S.No.3145 of 2004 and plaintiff in O.S.No.1403 of 2004 has agreed to pay a sum of Rs.3,00,000/- to the legal representatives of V.Srinivasan in full and final settlement.
3. Having paid the money and duly acknowledged by the representative of all the legal representatives of the appellant, the parties have now come forward with C.M.P.No.8345 of 2020. Wherein, Sridhar who is the respondent in this Second Appeal has sought leave of this Court to permit 1/3
S.Chakravarthi S/o. Late Srinivasan to execute a deed of receipt in respect of three mortgage deeds dated 15.09.1993, 17.09.1993 and 20.09.1993, listed as the document Nos.1831/1993, 1846/1993 and 1868/1993 in the office of SRO, T.Nagar. S.Chakravarthy who has come forward to execute a deed of receipt is none other than son of V.Srinivasan, the plaintiff in the suit which is the subject matter of the Second Appeal. Since the parties to the suit for recovery of money had arrived at compromise and filed memo of compromise, Lok Adalat has recorded the terms of compromise and as a consequence, the parties have now come forward seeking permission to register the deeds to complete transaction and give quietus to the litigation.
4. This Court is of view that there is no impediment in allowing the prayer sought in C.M.P.No.8435 of 2020. Accordingly, this Civil Miscellaneous Petition is allowed.
