ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] Seeking a direction to the respondents herein to produce the body of the detenu by name Sithaiyan, Son of Periyaarapuli of aged about 55 years, the present Habeas Corpus Petition has been filed.

2. The petitioner is the son of the detenu and he is missing from 23.03.2017 onwards. However, a complaint has been given on 07.08.2018 for which man missing case has been registered in Cr. No. 111 of 2018.

3. The learned Additional Public Prosecutor submitted that the investigation is still going on. Thus, we are not inclined to keep this petition pending any longer especially when the complaint itself has been given nearly after 1 1⁄2 years.

4. In view of the above, the Habeas Corpus Petition stands closed. However, the respondent/police shall proceed with the investigation. As and when the detenu is secured, he should be produced before the jurisdictional Magistrate.
