Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus directing the first respondent to provide the police protection to the revenue authorities to do the Survey Measurement bearing S.No.72/3 (having 30 cents Pidariamman Temple) and S.No.72/4b(1 acre of Boomidana Land) having an total extent of 1.30 acres of land situated at Meliruppu Village, Panruti Taluk, Cuddalore District-607 103.

O R D E R
This petition has been filed seeking a direction to the first respondent to provide police protection to the Surveyor to survey the land comprised in S.No.72/3 (having 30 cents Pidariamman Temple) and S.No.72/4b(1 acre of Boomidana Land) having an total extent of 1.30 acres of land situated at Meliruppu Village, Panruti Taluk, Cuddalore District-607 103.

The petitioner is being the former president of the Village Panchayat, to remove the encroachers and retrieve his temple land bearing S.No.72/3 (having 30 cents Pidariamman Temple) and S.No.72/4b(1 acre of Boomidana Land) having an total extent of 1.30 acres of land situated at Meliruppu Village, Panruti Taluk, Cuddalore District-607 103, submitted an application before the revenue authorities 2/4
in order to survey the subject property. He had also paid the requisite fees.
3. When the Surveyor about to survey the subject property, the third respondent along with others had obstructed to survey the land.

In view of the above, if the Surveyor finds any hindrance or obstructions at the hands of the third respondent, the Surveyor can very well seek for police protection before the first respondent and on receipt of such request, the first respondent is directed to conduct enquiry and pass appropriate order to provide adequate police protection to the Surveyor while surveying the subject property.
5. With the above direction, this writ petition is disposed of. No costs.
