JUDGMENT

When the matter is taken up for hearing today, it is represented by the learned counsel appearing for the appellant that the sole appellant

died on 15.07.2023 and also filed a copy of the death certificate. Since no legal heir filed a petition to proceed further with the appeal within a period of one month, as per proviso to Section 394 Cr.P.C. the charge against the accused is abated.
