O R D E R

(ORDER OF THE COURT WAS MADE BY M.DURAISWAMY, J.) The petitioner has filed the above Writ Petition to issue a Writ of Mandamus to direct the respondents 1 to 4 to remove the encroachment illegally occupied by the respondents 5 to 7 in the road situated in Pudurkadampatty, Muthunaickenpatty Village, Omalur Taluk, Salem District in S.No.402/9, 402/10, 402/14 by considering the representation dated 10.11.2018 by the petitioner.

2.On a reading of the affidavit filed in support of the petition, it could be seen that the petitioner has averred that the land alleged to have been encroached by the private respondents 5 to 7 is the only way to reach his house and due to the encroachment of the private respondents, they are unable to reach their houses. From the averments stated in the affidavit filed in support of the petition, it is clear that the dispute is between the petitioner and the private respondents. That being the case, the remedy open to the petitioner is only to file a Civil Suit as against the private respondents for removing the encroachment. In such view of the matter, we are not inclined to entertain the Writ Petition. Accordingly, the Writ Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
