ORDER

This petition has been filed to quash the proceedings in S.T.C.No.1449 of 2022 on the file of the learned Judicial Magistrate No.1, Namakkal, thereby taken cognizance for the offence punishable under Section 138 of the Negotiable Instruments Act, as against the petitioner. 2.

The learned counsel appearing for the respondent submitted that now the trial has been commenced and the respondent is examined as P.W.1 and the case is posted for cross-examination of P.W.1. 3.

After commencement of trial, the quash petition cannot be entertained and it is liable to be dismissed. However, the trial Court viz., learned Judicial Magistrate No.1, Namakkal, is directed to complete the trial in S.T.C.No.1449 of 2022, within a period of three months from the date of receipt of a copy of this Order.
