ORDER
This Writ Petition has been filed seeking for re-survey of the land morefully disclosed in the affidavit filed in support of this writ petition.
2. According to the petitioner, the earlier survey conducted by the Taluk Surveyor is improper and was not done in accordance with law. In those circumstances, the petitioner seeks for re-survey of his land through the 3rd respondent.
3. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3. Since no adverse order is Page No.2 of 6
passed against the 4th respondent in this writ petition, notice to the 4th respondent is dispensed with by this Court.
4. No prejudice would be caused to the respondents, if a direction is issued to the 2nd respondent to re-survey the petitioner's land with the assistance of the 3rd respondent, after hearing the objections of the 4th respondent and all other neighbouring land owners as well as any other party, whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's contentions raised in this writ petition.
5. For the foregoing reasons, this Court directs the 2nd respondent with the assistance of the 3rd respondent to conduct re-survey of the property morefully disclosed in the affidavit filed in support of this writ petition, after hearing the objections, if any, from the 4th respondent and the other neighbouring land owners as well as any other party, whom the 2nd respondent deems it fit to put on notice, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
