By consent, the writ petition is taken up for final disposal.
2.The writ petition is filed by the petitioner challenging the enquiry proceedings of the first respondent in Na.Ka.8522/2016/Aa2 dated 20.12.2016 and to quash the same. 3.Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing on behalf of the first respondent.
4.The only grievance of the petitioner is that he has been issued with a show cause notice on the complaint given by the second respondent for cancellation of patta. When the show cause notice was issued and asked him to appear on 29.12.2016, immediately, he sent a notice calling upon the authorities to provide him the copy of the complaint so as to enable him to give his explanation, for which, a letter has been sent by the https://hcservices.ecourts.gov.in/hcservices/
authorities to the petitioner stating that since the proceedings is on, the copy of the complaint cannot be furnished to him and further, he was directed to appear for enquiry.
5.Suffice for this Court to state that the first respondent shall furnish the copy of the complaint given by the second respondent to the petitioner so as to enable him to give his explanation. The said exercise shall be complied with by the first respondent, within a week from the date of receipt of a copy of this order and the petitioner is also directed to appear for enquiry whenever he is called for, by the authorities concerned.
6.It is also made clear that the proceedings shall go on and there is no dispute upon the power vested with the authorities.
7.This writ petition is disposed of, with the above directions. Consequently, connected Miscellaneous Petition is also closed. No costs.
