Respondents Prayer: Petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus, to direct the respondents to issue Vending Certificate to the Members of the petitioner sangam as mentioned in the membership list to carry on their business on the pavement of Muthusamy Road, Near Vinayakar Koil (Old Bhavani Petrol Bunk), Broadway, Chennai - 600 003 by taking into consideration of their representations dated 20.11.2025 dated 30.01.2026.

ORDER
(Order of the Court was made by R.SURESH KUMAR, J.) The prayer sought herein is for a writ of mandamus, to direct the respondents to issue Vending Certificate to the Members of the petitioner Sangam, as mentioned in the membership list, to carry on their businesses on the pavement of Muthusamy Road, Near Vinayakar Koil (Old Bhavani Petrol Bunk), Broadway, Chennai - 600 003, by taking into consideration of their representations dated 20.11.2025 and 30.01.2026.

It is claimed by the petitioner that, its Association consists of various Members, who are doing hawking business in the Muthusamy Road near Broadway, Chennai - 600 003, and in order to get licenses and identity cards to continue their hawking businesss in the said locality, the Members of the petitioner Association have already approached the respondent Corporation and in order to consider their plea individually, that is the Members of the petitioner Association, the petitioner Association seeks a mandamus.

Heard Mr.D.B.R.Prabhu, learned Standing Counsel appearing for the respondent Corporation, who, on instructions, would submit that, since the said Muthusamy Street is a vending zone, as already been declared so, the plea raised by the petitioner Association, on the basis of individual requests being made in this regard to the Town Vending Committee of the respondent Corporation, would be considered on merits and in accordance with law and accordingly, whenever such individual applications are being made, the same would be decided then and there by the concerned Town Vending Committee and the Greater Chennai Corporation under the provisions of the Street Vendors Protection of Livelihood Regulation Act, 2014.

Considering the said submissions made by the learned counsel appearing for both sides, this Court is inclined to dispose of this writ petition with the following orders:- (i) That, there shall be a direction to the respondents to consider the pleas raised by the petitioner Association, that means, individual Members of the petitioner Association, if they make individual applications in the prescribed format to the respondent Town Vending
Committee, seeking permission or license or identity cards to have or continue to have hawking business in the street concerned, namely, Muthusamy Road, which being a hawking zone or vending zone, as already been declared so.
(ii) The individual pleas, to be made in this regard or already been made in this regard by the individual Members of the petitioner Association, shall be considered and decided on merits and in accordance with law by the respondent Corporation through their Town Vending Committee within a period of eight weeks from the date of such applications made by the individual Members of the petitioner Association.
