Order This writ petition has been filed, challenging the undated order passed by the third respondent, rejecting the petitioner's application dated 26.12.2025 seeking for transfer of Patta in his name for the property, morefully disclosed in the prayer to this writ petition.

2.The petitioner has challenged the impugned order on the ground of violation of principles of natural justice and on the ground that it is a non speaking order. The petitioner categorically contends before this court through the help of the supporting documents filed along with this writ petition that he is the owner of the property and is in possession of the same. According to the petitioner, arbitrarily by not adhering to the principles of natural justice and by not considering the supporting documents produced by the petitioner, the third respondent has passed the impugned order.

3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.

4.As seen from the impugned order, it is a non-speaking order. The reason for rejecting the petitioner's application seeking for transfer of Patta is given in the tabular column and it reads as follows:

The third respondent has also not considered the supporting documents produced by the petitioner along with the application dated 26 12 2025 seeking for transfer of Patta. Being a non-speaking order and an order passed in violation of principles of natural justice, necessarily, the impugned undated order passed by the third respondent has to be quashed and the matter has to be remanded back for fresh consideration, on merits and in accordance with law.

6.Accordingly, the impugned undated order passed by the third respondent is hereby quashed and the matter is remanded back to the third respondent for fresh consideration, on merits and in accordance with law. The petitioner shall submit a written explanation along with the supporting documents to the third respondent giving details as to how the petitioner is entitled for transfer of Patta in his name, within a period of 2 weeks from the date of receipt of a copy of this order. On receipt of the written explanation within the stipulated time from the petitioner, the third respondent shall pass final orders, on merits and in accordance with law on the petitioner's application dated 26.12.2025 seeking for transfer of Patta, after giving due consideration to

the written explanation as well as the supporting documents produced by the petitioner and after hearing all the necessary parties, within a period of 12 weeks thereafter.
