ORDER
This Criminal Original Petition has been filed seeking to quash the charge sheet in CC No. 1741/2022 filed by the respondent police in F.I.R.No.287 of 2022 registered against the petitioner under Sec.448 of I.P.C. 2.
Today, when the matter was taken up for hearing, the learned Addl. Public Prosecutor appearing for the first respondent Police submitted that the trial has been commenced in this case and so far, three witnesses have also been examined. Now, the case is posted for hearing on 05.01.2026.
3. Taking into consideration the fact that the trial was commenced and so far, three witnesses have been examined, nothing survives for further adjudication in this petition.
4. At this juncture, the learned counsel appearing for petitioner would submit that the presence of the petitioner before the trial court may be dispensed with.
5. Considering the submission made by the learned counsel for petitioner, the presence of the petitioner before the trial court in C.C.No. 1741 of 2022 is dispensed with, except appearing for questioning under Sec.313 __________Page 2 of 4
Cr.P.C. for the purpose of identification and at the time of judgment. The petitioner shall be represented by a counsel before the trial court on all hearing dates.
6. This Criminal Original Petition stands disposed of accordingly. Consequently, connected miscellaneous petitions are closed.
