This Second Appeal has been filed to set aside the Judgment and Decree in A.S.No.28 of 2012 dated 14.12.2012 on the file of the II Additional District Judge, Tindivanam reversing the Judgment and Decree in O.S.No.83 of 2010 dated 29.02.2012 on the file of the Principal Sub Judge, Tindivanam.

2.No representation for the appellant. The learned counsel for the respondent present. It is seen from the records that the sole appellant died on 16.11.2017 itself. But, so far steps not taken to bring the legal heirs of the sole appellant. Hence, this second appeal is dismissed as abated. No costs. Consequently, the connected miscellaneous petition is also closed.
