The learned counsel appearing for the petitioner submitted that the petitioner prefered statutory appeals before The Commissioner of Geology and Mining and the said appeals were rejected by the Commissioner on 29.01.2013 and 04.04.2013. As against the said orders, the petitioner preferred second appeals before the respondent on 12.2.2013 and 23.4.2013. Further, the learned counsel submitted that inspite of the second appeals, pending for more than three years, the respondent has not disposed of the same yet.

Mr.A. Zakir Hussain, learned Government Advocate, appearing for the respondent, submitted that in view of the submissions made by the learned counsel for the petitioner, the respondent may be directed to dispose of the appeals within a stipulated time, in accordance with law.

Having regard to the submissions made by the learned counsel on either side and taking into consideration the limited prayer sought for by the petitioner, without expressing any opinion with regard to the merits of the case, I direct the respondent to dispose of the appeals, preferred by the petitioner, dated 12.2.2013 and 23.4.2013, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order, after giving due opportunity of personal hearing to the petitioner.
