PRAYER: Writ petition has been filed under Article 226 of Constitution of India to issue a Writ of Certiorari calling for entire records pertaining to the impugned proceedings in Na Ka no. A1/389/1999 dated 25.10.2024 of the 4th respondent and quash the same.

ORDER

This petition has been filed to call for entire records pertaining to the impugned proceedings in Na Ka no. A1/389/1999 dated 25.10.2024 of the 4th respondent and quash the same.

Earlier, this Court had dismissed the writ petitions in W.P.Nos.23442, 23500 and 23557 of 2014 by an order dated 19.10.2022, wherein, this Court has observed as follows:

"4.I am unable to sustain the said argument of the learned counsel, inasmuch as the period of lease itself is over and the petitioners have no legal right to continue in the premises. After all the Corporation is the owner of the property and it has the right to use the property to its best advantage and the petitioners cannot claim a permanent tenancy. De hors the claim of subletting, once the license period is over, the petitioners are bound to vacate and hand over possession.

5.I therefore see no merit in the writ petitions. The writ

petitions fail and are accordingly dismissed. No costs. Consequently, the connected writ miscellaneous petitions are closed."

From the perusal of the said order, it is clear that this Court has clearly stated that the petitioner has no legal right to continue in the premises and he was also directed to vacate and hand over the possession, which has not been done till date and on the contrary, the petitioner has come with this writ petition seeking to quash the order, in and by which, the respondent has claimed all the rental arrears from the petitioner for a period from April 2003 to August 2024. The petitioner has neither paid the rents nor vacated the premises, but, continues to squat on the property.

Therefore, in the light of the earlier order passed by this Court, this writ petition is not maintainable and is accordingly, dismissed. Consequently, connected miscellaneous petitions stand closed. No costs. 09-02-2026 Index: Yes/No Speaking/Non-speaking order ssa
