M/S. Cholamandalam Investment v. Mr Vediyappan M (Decd.)

APPLICATION No.3617 of 2014 S.VIMALA, J., The applicant has filed this application seeking direction to the sole respondent, namely, M.Vediyappan, to furnish security to the tune of Rs.6,69,666.70.

2. On the death of the sole respondent, his wife and son are brought on record as respondents 2 and 3 and this Court, by order dated 01.03.2017, directed to the respondents to furnish security to the claim made by the Applicant, within a period of six weeks.

3. The said order has been communicated to the respondents. But, the same has been returned as "Refused". Affidavit of service has also been filed to that effect. Therefore, the service of the respondents is held sufficient.

4. It is represented by the learned counsel appearing for the Applicant that, despite notice having been served on the respondents, of which proof of service has been filed, there is no appearance on behalf of the respondents. The respondents also failed to furnish the security, as ordered by this Court, earlier.

5. As stated in the order dated 01.03.2017, the security is not furnished by the respondents. Hence, properties are ordered to be attached.

6. With the said directions, this Application is closed.
