G.O. (Ms) No 335, Health and Family Welfare, (MCA -2) Department dated 29.07.2021, ii. G.O. (Ms) No 98, health and Family Welfare, (MCA -2) Department dated 25.01.2023 for the service rendered between February 2022 to March 2023 during 1st year and for one month of 2nd year together with interest till date. ORDER

The present Writ Petition has been filed seeking to direct the respondents to pay the arrears of stipend amount to the tune of Rs.1,30,000/- in favour of the petitioner for the service rendered between February, 2022, to March, 2023, during 1st year and for one month of 2nd year together with interest till date.

2. The case of the petitioner is that she pursued her Post Diploma DNB in (NBE) Otorhinolargngology during the period between February, 2022, and February, 2024, at Government Headquarters Hospital, Kancheepuram and successfully completed the course. As per the Government Orders namely, (i) G.O. (Ms) No 335, Health and Family Welfare, (MCA -2) Department dated 29.07.2021, (ii) G.O. (Ms) No 98, health and Family Welfare, (MCA -2) Department dated 25.01.2023, the stipend amount has been revised from Rs.35,000/- to Rs.45,000/- per month with retrospective effect from 29.07.2021, prior to the commencement of the petitioner's training. However, the petitioner was paid only the old stipend amount of Rs.35,000/-, thus the arrears of the difference in amount totalling Rs.1,30,000/- have not been paid to the petitioner. Hence, the petitioner submitted a representation on 20.12.2024 requesting the disbursal of the accumulated arrears of stipend amount. As the same has not been considered, the petitioner is constrained to file the present Writ Petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for respondent Nos.1 to 6.

4. The learned counsel for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents to consider the petitioner's

representation dated 20.12.2024 and to consequently, pay the arrears of stipend amount to the tune of Rs.1,30,000/- in favour of the petitioner, together with interest, as expeditiously as possible.

5. The learned Additional Government Pleader appearing for the respondents submitted that appropriate orders will be passed on the petitioner's representation dated 20.12.2024 within a time frame that may be fixed by this Court.

6. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the 5th respondent to consider the petitioner's representation dated 20.12.2024 and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
