The petitioner seeks anticipatory bail in Crime No.3 of 2024 registered by the respondent Police for the offences punishable under Sections 379 of IPC.
2. It is stated that the defacto complainant was the owner of a Maruti Swift Car bearing Reg.No.TN 09 DD 2569. He had rented the car to this petitioner for Rs.1,500 per day for a period of 4 days. Thereafter, he asked the petitioner to give the car back and the petitioner also parked the car at the place where the defacto complainant told him to do so. Later, it is alleged this petitioner using a duplicate key had stolen the car. 3.The learned counsel for the petitioner stated that the petitioner had parked the car at the place where the defacto complainant told him to do so and a third person had taken away the car. 4.The learned Government Advocate (Crl. Side) submitted that the there is one previous case of similar nature pending as against the petitioner, 1/3
wherein anticipatory bail has been granted. However, the petitioner had not executed the surety.
5. Taking all these factors into consideration, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
