ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the respondents to consider the representation of the petitioners dated 18.10.2023 to re-convey the un-utilized land measuring an extent of 8.25 acres comprised in Survey Nos.141/1A (3.41 acres) and 141/2A (4.84 acres) situated at Nandambakkam Village, Alandur Taluk, Chennai in favour of the petitioners within the time fixed by this Court.

3. Heard learned counsel for the petitioners and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

The case of the petitioner is that the land comprised in S.Nos.141/1A [3.41 Acres] and 141/2A [4.84 Acres] measuring total extent of 8.25 Acres situated at Nandambakkam Village, Alandur Taluk, Chennai was acquired by the first respondent vide notification dated 10.07.1962 for industrial purpose and compensation has also been awarded. But the said land has not been utilized for more than 60 years. Hence, the petitioners gave a representation to the respondents to reconvey the said property and the same has not been considered till date. Hence, the present Writ Petition.

5. It appears that the land was acquired in the year 1962. However, the same has not been utilized. When the land has been acquired and the compensation amount has been received, at this stage the petitioners cannot seek a direction to consider the representation of the petitioner to reconvey the land acquired from the petitioners. Hence, I do not find any merits in this Writ Petition.

6. Accordingly, this Writ Petition is dismissed. No costs. 15.04.2024 vrc 3/5
