Perumal COMMON JUDGMENT The appellant/wife has filed these Civil Miscellaneous Appeals challenging the order and decreetal order dated 09.01.2024 made in CMA.No.16 and 15 of 2022 on the file of the I Addl. District Judge, Thiruvallur,
confirming the order and decreetal order dated 12.09.2022 passed in HMOP.Nos.59 of 2018 and 90 of 2019 on the file of the Subordinate Judge, Tiruttani denying relief of restitution of conjugal rights and granting decree of divorce by dissolving the marriage between the appellant and respondent.
2. The appellant-B. Yamini and the respondent- R.Suresh Babu are present before this Court along with their respective counsels.
3. This Court, by order dated 25,06.2025, referred the matter before Mediation and Conciliation Centre, Chennai for mediation, wherein, on 24.10.2025, the matter has been amicably settled between the parties, and in pursuance of the same, a Settlement Agreement has also been entered between the parties on 24.10.2025.
4. The appellant B.Yamini states that she has received Term Deposit for an amount of Rs.20,00,000/- (Rupees twenty lakhs only) in favour of their son and also received a Demand Draft for an amount of Rs.10,00,000/- (Rupees ten lakhs only) on 24.10.2025 at the Mediation Centre towards permanent alimony.
5. A Joint Memo dated 04.11.2025 has also been filed stating that the proceedings pending before the Family Court, Thiruvallur in M.C.No.39 of
2022 filed by the appellant/wife and GWOP.No.2025 filed by the respondent/husband are to be withdrawn by the appellant and respondent herein and there are no future claims as against both parties. The Joint Memo dated 04.11.2025 is hereby taken on record.
5. In view of the above, these Civil Miscellaneous Second Appeals appeal stand disposed of in terms of Settlement Agreement dated 24.10.2025 and the Joint Memo dated 04.11.2025. The Settlement Agreement and the Joint Memo shall form part of the decree.
6. In the result, ● these Civil Miscellaneous Second Appeals stand disposed of in terms of Settlement Agreement dated 24.10.2025 and the Joint Memo dated 04.11.2025. ● The Settlement Agreement dated 24.10.2025 and Joint Memo dated 04.11.2025 form part of the decree. ● The connected miscellaneous petitions are closed.
