ORDER
This writ petition has been filed to direct the respondents 1 to 3 to forthwith remove the sealing of "Slim and Tone Lifestyle and Fitness Studio" effected by the respondents 2 and 3 on 12.01.2023 at the premises morefully described in the prayer to this writ petition.
2. The petitioners claim to be the owners of the property and the respondents 4 to 6 are their tenants. Earlier, the petitioners made a request to the respondents 1 to 3 to seal the premises occupied by the respondents 4 to 6, as their tenants on account of the respondents 4 to 6 not possessing any licence to run the GYM. Based on the request made by the petitioners, the respondents 2 and 3 had also sealed the premises on 12.01.2023.
3. The petitioners had also filed a civil suit, seeking for payment of arrears of rent from the respondents 4 to 6 and also sought for eviction. The Civil Court had also granted a decree in favour of the petitioners against the respondents 4 to 6 as prayed for in the suit. The petitioners have also filed an
execution petition to execute the said decree against respondents 4 to 6.
4. The petitioners claim that due to the sealing of the premises by respondents 2 and 3 on 12.01.2023, the petitioners were unable to take possession of the property through orders passed by the executing court.
5. Mr. E.C. Ramesh, learned Standing Counsel accepted notice on behalf of the respondents 1 to 3.
6. Since no adverse orders are passed against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with by this Court.
7. The written instructions received by the learned Standing Counsel appearing for the respondents Corporation has been placed on record before this Court. As seen from the same, the respondents 2 and 3 have decided to remove the seal of the premises on 14.03.2026 at 11:00 A.M., since there is no requirement of a licence to run a gym.
8. Since the respondents 2 and 3 have undertaken to remove the seal from the premises, which was earlier occupied by the respondents 4 to 6, the prayer sought for in this writ petition will be achieved by the petitioners once the seal is removed by the respondents 2 and 3 on 14.03.2026.
9. After recording the undertaking given by the respondents 2 and 3 that they shall remove the seal from the premises on 14.03.2026 at 11:00 A.M., this
writ petition is disposed of by directing the respondents 2 and 3 to remove the seal from the premises, which was earlier occupied by the respondents 4 to 6 on 14.03.2026 at 11.00 A.M. and they shall also hand over the fuse carriers of the premises back to the petitioners, who are the owners of the property. With regard to the items available in the sealed premises, it is left open for the Executing Court to decide as to whom it has to be handed over. No Costs.
