1 CMP. No.6109 of 2022 C.M.P. No.6109 of 2022 in Tr.C.M.P. No.45 of 2020 S.KANNAMMAL.J., This application has been filed seeking to set aside the order of dismissal dated 11.09.2020 passed by this Court in Tr.C.M.P. No.45 of 2020 and restore the same.

2. The learned counsel for the respondent has no objection to allow the present application.

3. The learned counsel for the petitioner submitted that the respondent has obtained stay of the proceedings in HMOP No.394 of 2019 by order of the Apex Court in SLP No.6423 of 2020.

4. In view of the submissions of the learned counsel for both sides, this Court is inclined to allow the application and accordingly, Tr. C.M.P. No.45 of 2020 shall be restored.

5.Post the matter after three weeks.
