Prayer : Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus by quashing the impugned order, dated 25.10.2024 of cancelling the electricity service connection online Application No.200083310924318 passed by the respondents and directing the respondents 1 to 4 to give electricity service connection based on the said application to my mud-hut situated in S.No.44/7 of Vayaloor village, Uthiramerur taluk within a stipulated period of time.

ORDER
This Writ Petition is filed challenging the impugned order, dated 25.10.2024 cancelling the electricity connection online application submitted by the petitioner in Application No.200083310924318.
2. The case of the petitioner is that there is a mud-hut situated in S.No.44/7 of Vayaloor village, Uthiramerur taluk. When the petitioner duly applied for the electricity connection in respect of the same, without any justification whatsoever, merely on the petitions made by certain persons 2/7
who are inimically disposed of towards this petitioner, the electricity connection is now refused.
3. When the matter is taken up for hearing, Mr.D.B.R.Prabhu, learned Counsel, taking notice for the respondents, would submit that the petitioner has a pucca terraced house inside the village. This is his land, in which, there is a small shed and there is also a single HP motor which is run by the petitioner. The entire operations are unauthorised. This will not come within the definition of mud-hut connections which is domestic in nature. There is no evidence of residence or a kitchen being there in the hut.

In view thereof, when the respondent authorities are not agreeing to the fact that it is a house, then, if the petitioner is carrying on any cottage industry or allied activities of agriculture under the respective Low Tension Tarriffs, Low Tension Tarriff - III-A(1) or if the petitioner wants agriculture connection under the Low Tension Tariff - IV, he may apply. such an application is made, the authorities shall effect the connection in accordance with law as expeditiously as possible.
5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
