( Civil Appellate Jurisdiction ) Tuesday, the Second day of November Two Thousand Twenty One PRESENT THE HON`BLE MS.JUSTICE V.M.VELUMANI CRP(NPD).No.2002 of 2018 USAIN [ PETITIONER ] Vs 1 N.SAMBOORNAM [ RESPONDENTS ] 2 M.JOTHI 3 M.MEENA Under section 115 code of CPC filed against to set aside the fair and decretal order of the lower court made in IA.No.8695/2017 in OS.No.6813/2014 dt.22/08/2017 and allow the same [in CRP(NPD). No.2002 of 2018].

ORDER: This Petition coming on for Extension of time on the Second day of November Two Thousand Twenty One and perusing the earlier order dated 15.10.2020 and letter dated 04.10.2021 vide D.No.10359/2021 from the XVII Assistant Judge, (FAC) XVIII Assistant Court, City Civil Court, Chennai, this court made the following order:

By the order dated 15.10.2020, this Court allowed the Civil Revision Petition with a direction to the XVIII Assistant Judge, City Civil Court, Chennai, to dispose of the suit within a period of six months from the date of resumption of the physical hearing in the Courts at Chennai.

2.The learned XVII Assistant Judge, (FAC) XVIII Assistant Court, City Civil Court, Chennai, by a letter to the Registry dated 04.10.2021, seeks six months time to dispose of the suit on the ground that the directions issued by this Court has been brought to his knowledge only on 30.09.2021 and hence, speedy disposal of the case has been delayed.

3.Considering the reasons stated by the learned XVII Assistant Judge, (FAC) XVIII Assistant Court, City Civil Court, Chennai, six months time is hereby granted to dispose of the suit in O.S.No.6813 of 2014, from the date of receipt of a copy of this order. -sd/- 02/11/2021 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
