ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.03.2024 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.82 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 04.03.2024, based on secret information, the respondent police intercepted the petitioner and another accused and found them in possession of 45 kgs of ganja. Hence, the case was registered.

3. When the matter came up for hearing, there was no representation on behalf of the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that this is the seventh bail application and the case involves commercial quantity. It is further submitted that the trial is in advanced stage.

5. I have given anxious consideration to the submission of the learned Government Advocate (Crl. Side).

6. From the submission of the learned Government Advocate (Crl.Side), this Court is of the view that the case involves commercial quantity and this is the seventh bail application of the petitioner. Further considering that the trial is in advanced stage. Besides, this Court does not find any material to overcome the rigour under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Hence, this Court is not inclined to enlarge the petitioner on bail.
