The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 279 of IPC and Sections 4(1) (aaa) and 4(1-A) of the Tamil Nadu Prohibition Act, 1937 in Crime No.76 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that during regular inspection/patrol conducted by the respondent police, they found that the petitioner was in possession of 200 Litres of Pondicherry ID Arrack. Hence, the complaint was registered.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Criminal Side) for the respondent would submit that the petitioner was in possession of 200 Litres of Pondicherry ID Arrack. He would further submit that there are thirteen previous cases pending as against the petitioner. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Taking into account the nature of offence and the submissions of either sides, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
