ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1st respondent to reissue/renewal the passport of the petitioner considering the application submitted by the petitioner on 22.10.2024. 2.The learned Government Advocate appearing on behalf of the 2nd and 3rd respondents submitted that an FIR came to be registered in Crime No.418 of 2022 by the 3rd respondent against the husband of the petitioner for offence under POCSO. The petitioner has also been added as an accused in this case.

3/5 3.In the considered view of this Court, a mere registration of an FIR which is pending investigation, cannot be a ground to deny reissue/renewal of passport in favour of the petitioner. Therefore, there shall be a direction to the 1st respondent to act upon the application submitted by the petitioner on 22.10.2024 and renew/reissue the passport in the name of the petitioner, within a period of four weeks from the date of receipt of copy of this order. It goes without saying that if the petitioner wants to go out of the country, she has to necessarily take the permission of the Court, where the criminal case is pending, provided that the petitioner's name also form parts of the final report. 4.This writ petition is disposed of with the above directions.
