Respondent Prayer: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondent for wilful disobdedience of the order passed by this Court dated 06.08.2015 made in Crl.O.P.No.19782 of 2015. For Petitioner :

O R D E R

This Contempt Petition has been filed by the petitioner alleging willful disobedience of the order passed by this Court on 06.08.2015 in Crl.O.P.No.19782 of 2015.

2.Today, when the matter was called, Mr.R.Paulraj, the Sub-Inspector of Police, Denkanikottai Police Station, Krishnagiri District is present.

3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.

4.In Crl.O.P.No.19782 of 2015, this Court had passed the following order on 06.08.2015:

"3.The learned Additional Public Prosecutor appearing for the respondent submitted that a case in Cr.No.393 of 2014 has been registered and is being investigated by the respondent police.

4.In view of the above, the Criminal Original Petition is disposed of with a direction to the respondent police to complete the investigation and file a final report as expeditiously as possible."

5.The learned Additional Public Prosecutor would submit that investigation in Cr.No.393 of 2014 was completed and the case was closed as mistake of fact on 30.12.2014 in RCS.No.6 of 2014, which has been served on the de-facto complainant by affixing the same on the door of his house. He would submit that the closure report has been filed before the learned Judicial Magistrate, Denkanikottai on the same day. He would further submit

that unfortunately, it was not brought to the notice of this Court when Crl.O.P.No.19782 of 2015 was disposed on 06.08.2015.

6.In any event, this Court has not issued any positive direction in the order dated 06.08.2015 in Crl.O.P.No.19782 of 2015 and therefore, there is no question of violation of the said order by the respondent police.
