Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the second respondent to dispose of the appeal dated 26.08.2016 given by the petitioner within the reasonable time and consequently direct the 1st respondent to retrieve the Land in Survey No.986/1, 986/2 S.No.483 and totally spread over 4 Acres 30 cents from the accused.

Mr.R.Govindasamy, learned Special Government Pleader, takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a mandamus directing the second respondent to dispose of the appeal dated 26.08.2016 given by the petitioner within the reasonable time and consequently direct the 1st respondent to retrieve the Land in Survey https://hcservices.ecourts.gov.in/hcservices/

No.986/1, 986/2 S.No.483 and totally spread over 4 Acres 30 cents from the accused.

4. The grievance of the petitioner before this Court is that the said appeal has not been disposed of so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the 2nd respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the 2nd respondent to consider the appeal of the petitioner dated 26.08.2016 and pass orders on the same on merits and in accordance with law, after hearing the affected parties, if any. Such exercise shall be done by the 2nd respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
