PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 3 to shift the weekly market to the land situated at S.Nos.656/E2, E3, E4, E6, Karathozhavu Panchayat, Madathukulam Taluk, Tiruppur District, in the name of the 4th respondent and by considering the representation dated 4.12.2024.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard on admission.

The writ petition under Article 226 of the Constitution of India has been filed in the nature of public interest litigation espousing the grievance of the public at large that the weekly market be shifted to the land situated at S.Nos.656/E2, E3, E4, E6, Karathozhavu Panchayat, Madathukulam Taluk, Tiruppur District, as the weekly market being conducted on the road margin is affecting the public movement, causing heavy traffic congestion, besides accidents, parking issues and inconvenience to the commuters passing through the road.
3. Learned counsel for the petitioner would submit that he has already submitted a representation dated 4.12.2024 for shifting the weekly market to a particular place, however, the respondents are sitting tight over the matter and not taking any decision.
4. We find good reasons to entertain the writ petition. We find that the representation dated 4.12.2024 is addressed to respondent Nos.1 and 3 and not to the fourth respondent. In these circumstances, learned counsel for the petitioner is directed to submit a fresh representation to the fourth respondent within ten days from today. If such representation is filed, the fourth respondent shall consider the same in accordance with law and pass a reasoned and speaking order as per the requirement and local needs, as expeditiously as possible, preferably within eight weeks from the date of receipt of the representation.
5. Writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, interim application stands closed.
6. We make it clear that we have not expressed any opinion on the merits of the case.
