ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 457, 380 & 381 of I.P.C in Crime No. 498 of 2021, seek anticipatory bail.

2. The case of the prosecution is that the petitioner colluding with the other accused persons, who were the staff members of the Rice Godown run by the De-facto Complainant, had stolen rice bags worth about Rs.20,00,000/- from the said Godown. Hence, the law enforcing agency registered a case against the petitioner and other accused persons.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the co-accused persons were enlarged on bail by this Court. Hence he prays for grant of anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

The learned Government Advocate (Crl.Side) submitted that this is the second anticipatory bail application filed by the petitioner and the earlier anticipatory bail petition filed by the petitioner was dismissed by this Court. He further submitted that, the petitioner along with other accused persons have stolen rice bags worth about Rs.20,00,000/- from the Godown of the De-facto complainant and the balance rice stolen is yet to be recovered.

5. Considering the allegation levelled against the petitioner and further taking into consideration the gravity of the offence committed by the petitioner and as there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the present petition seeking anticipatory bail is dismissed.
