This Petition has been filed to condone the delay of 1234 days in filing the above captioned C.M.A against the decree and judgment passed in MACT.O.P.No.1517 of 2017, dated 11.06.2018 on the file of the Motor Accident Claims Tribunal, Special Sub Court, Tiruvannamalai.

2. Mr.M.Krishnamoorthy, learned counsel appearing for the 6th respondent filed a counter stating that no reasons have been given for the inordinate delay.

3.Though notice was served on the other respondents, none had entered appearance on his behalf before this Court. 4.Heard both sides.

5.Considering the averments made in the affidavit filed in support of this application and being satisfied with the same, the delay is condoned on the condition that the appellant shall be entitled to claim interest only from 01.01.2023, in the event of this Court enhancing the Award amount.
