This petition has been filed seeking permission of this Court to withdraw the entire amount of Rs.15,10,659/- deposited by the first respondent/appellant to the credit of M.C.O.P.No.877 of 2013, on the file of the Motor Accidents Claims Tribunal (II Small Causes Court), Chennai.
2. The learned counsel appearing on behalf of the first respondent has submitted that, as per the direction of this Court, in its order, dated 01.08.2016, in C.M.P.No.11951 of 2016 in C.M.A.No.1586 of 2016, an amount of Rs.15,10,659/-, representing 50% of the award amount, had been deposited to the credit of M.C.O.P.No.877 of 2013. It has been further stated that the respondents have no objection for the withdrawal of the said amount by the petitioners.

In such circumstances, the first petitioner is permitted to withdraw his share in the entire amount deposited, viz., Rs.15,10,659/- (Rupees fifteen lakhs ten thousand six hundred and fifty nine only). As far as the shares of the minor petitioners, namely, second and third petitioners are concerned, the same shall be invested in a fixed deposit, in a Nationalised Bank, initially for a period of three years, renewable thereafter from time to time, till the minors attain majority. The first petitioner is permitted to withdraw the interest accrued on the said amount, once in three months. Accordingly, this miscellaneous petition is ordered. (M.J.J.)
