APPLICATION NOS.5301 and 5302 of 2016 IN T.O.S.No.31 of 2014 PUSHPA SATHYANARAYANA, J These applications have been filed by the legal heirs of the deceased third defendant in T.O.S, namely, A.Rajendran @ Rajendra Prasad. The applicants are the wife and daughters of the deceased third defendant and they seek to set aside the abatement caused due to the death of the third defendant and to implead themselves to continue their proceedings.

Heard the learned counsel appearing for the applicants. Learned counsel for the plaintiff is not present.

Being satisfied with the reasons stated in the affidavit filed in support of the applications, these applications are allowed. 4.

The plaintiff is directed to carry out the amendment and file the amended copy of the plaint.

Post the matter after two weeks.
