Prayer: Appeal filed under Section 100 of Civil Procedure Code against the Judgment and decree of the Court of the Principal District and Sessions Judge, Erode dated 04.09.2012 made in Cross Appeal. No. 99/2011 reversing the Judgment and Decree of the Court of the Subordinate Judge, Gobichettipalayam dated 16.09.2011 made in O.S. No. 178/2001.

DECREE: This Second Appeal coming on for hearing on this day, upon perusing the grounds of appeal, the Judgment and Decrees of the Lower Appellate Court and the Court of first instance and the material papers in the case and upon hearing the arguments of Mr.Tranqubar Doraivasu for Mr.R.T. Doraisamy, Advocate for the Appellants and of Mr.P.Valliappan for the 1st Respondent and M/s.P.T. Ramadevi Advocate for the 2nd Respondent, this Court doth order and decree as follows:

1.That the Judgment and Decree of the Court of the Principal District and Sessions Judge, Erode dated 04.09.2012 made in Cross Appeal. No. 99/2011 reversing the Judgment and decree of the Court of the Subordinate Judge, Gobichettipalayam dated 16.09.2011 made in O.S. No. 178/2001 be and hereby is confirmed and this Second Appeal is dismissed; and

2. That there be no costs in this Second Appeal. s/d- Assistant Registrar True Copy Sub-Assistant Registrar dsa To 1.The Principal District and Sessions Judge, Erode.
