The petitioner who was arrested and remanded to judicial custody on 20.03.2020 for the alleged offence punishable under Sections 8(c) read with 20(b)(ii)(c), 29(1) of NDPS Act, in Crime No.22 of 2020, on the file of the respondent police, seek bail.

2. The case of the prosecution is that there are two accused involved in this case and the petitioner herein is arrayed as A1. On the date of occurence, the petitioner was in possession of 23 kgs. Of Ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that this is the 6th bail application of the petitioner. The petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner was in possession of 23 Kgs. Of Ganja. He further submits that there is no previous case pending against the petitioner.

5. Taking into consideration the allegations and also the fact that the petitioner was in possession of 23 Kgs of Ganja, which is commercial quantity M.DHANDAPANI,J.

Crl.O.P.No.6477 of 2023 Rli and that the custodial interrogation of the petitioners is essential, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.

6. It is submitted by the learned counsel for the petitioner that the trial Court may be directed to complete the trial within the reasonable time as fixed by this Court.

7. In this regard, this Court directed to call for the report from the respective Court and the Report has also been received and the learned Judge seeks time for six months to complete the trial. At her request, this Court directs the learned Special Judge, FAC, II Additional Special Court, Special Court under NDPS Act, Chennai to complete the trial within a period of six months from the date of receipt of a copy of this order. 17.07.2023 rli Copy to- The Special Judge, FAC, II Additional Special Court Under NDPS Act, Chennai-104.
