ORDER
This Criminal Miscellaneous Petition has been filed to suspend the sentence imposed on the petitioner/appellant by the learned Sessions Judge
(Special Judge for POCSO Act Cases) Thiruvannamalai, Thiruvannamalai District made in Spl.S.C.No.42 of 2019 by Judgment dated 29.12.2022 and enlarge him on bail pending disposal of the Appeal in Crl.A.No.477 of 2024.
2. It is seen that pending appeal, earlier also the petitioner filed a petition before this Court in Crl.M.P.7086 of 2024 seeking suspension of sentence and this Court, by considering the serious nature of offence, dismissed the said petition by order dated 19.06.2024. Once again the petitioner/appellant has filed the present petition seeking to suspend the sentence. But there is no change in circumstances and also considering the serious nature of offence and the age of the victim, this Court is not inclined to entertain this petition.
3. Accordingly, this Criminal Miscellaneous Petition is dismissed.
4. Since the records have already been received, this Court is inclined to take up the main appeal itself.
