PRAYER: This Criminal Original Petition filed under Section 482 of Cr.P.C., to direct the learned Judicial Magistrate No.1, Udumalpet, Tirupur District for speedy disposal of the said C.C.No.14 of 2016 within a time frame as fixed by this Court by allowing this Criminal Original Petition.

O R D E R

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.1, Udumalpet, Tirupur District for speedy disposal of C.C.No.14 of 2016 within a time frame as fixed by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the complainant in C.C.No.14 of 2016, pending on the file of the learned Judicial Magistrate No.1, Udumalpet, Tirupur District for the offence under Section 138 of NI Act. He would further submit that the evidence on the side of the complainant has been completed, thereafter, the case was posted for questioning under Section 313 of Cr.P.C. Later, the case was posted for defence side witnesses on 27.10.2021. Thereafter, the case was repeatedly adjourned and posted on 05.04.2022, even on that day, the respondent has not let in evidence on his side. The case was prolonged from the year 2016 and there is no progress in this case. Thereby, the present petition has been filed for speedy disposal of the trial.

3. In view of the above, direction is issued to the learned Judicial Magistrate No.1, Udumalpet, Tirupur District to complete the trial in C.C.No.14 of 2016 as expeditiously as https://hcservices.ecourts.gov.in/hcservices/

possible, preferably, within a period of two months from the next hearing date, before the trial Court.

4. With the above direction, this Criminal Original Petition stands disposed of.
