ORDER
By consent of both the parties, this writ petition has been taken up for final disposal at the admission stage itself.
2. This writ petition has been filed seeking to issue a WRIT OF MANDAMUS directing the second respondent to consider the petitioner's representation dated 8.05.2019 and to pass orders.
3. The case of the petitioner in brief:
The petitioner was working as Junior Assistant/ Tax Collector at Veerakanur Town Panchayat at Salem District and he retired from service on 30.06.2015 on superannuation. The petitioner applied for encahsment of Earned Leave for 139 days, however, he was paid only for 30 days of Earned Leave. When the petitioner asked the second respondent to deposit the amount for the remaining 106 days of Earned Leave, they replied that the https://hcservices.ecourts.gov.in/hcservices/
petitioner did not attend the Bhavani Sagar Government Training programme for Junior Assistant. But the fact that, though the petitioner was ready and willing and also approached the respondents several times to permit him to attend the above Training, they did not provide opportunity to attend the training. The petitioner gave representation on 08.05.2019 to the second respondent to pay the balance amount for 106 days of Earned Leave. But they did not responds till date. Hence this writ petition.
4. The learned Additional Government Pleader appearing for the respondents submitted that the representation of the petitioner will be considered by the authorities concerned and appropriate orders will be passed on its own merits, in accordance with law.
5. Inview of the above submission and considering the limited scope of prayer and to meet the ends of justice, without expressing any opinion on merits, the following order is passed. i) The second respondent is directed consider the representation of the petitioner dated 08.05.2019 and to pass orders on its own merits and in accordance with law, as early as possible, within a period of twelve weeks from the date of receipt of a copy of this order.
6. With the above direction, this writ petition is disposed of . No costs.
