PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to grant permission to conduct 'Eruthu Vidum Vizha' (Jallikattu festival) on 06.4.2018 or any other date at Thekkkupattu Village in Natrampalli Taluk of Vellore District by considering the petitioner's representation dated 23.3.2018. Mr.T.N.Rajagopalan, GP Order of the Court was made by T.S.SIVAGNANAM,J Mr.T.N.Rajagopalan, learned Government Pleader accepts notice for the respondents. Heard both.
2. The petitioner seeks a direction to the respondents to grant permission to conduct jallikattu festival on 06.4.2018 i.e. today.
3. As rightly pointed out by the learned Government Pleader, the date fixed for the festival falls today and therefore, the question of directing the respondents to grant permission for a festival to be conducted today is not feasible of compliance. This would have been sufficient to dismiss the above writ petition.
4. However, the learned counsel for the petitioner submits that the petitioner will make a fresh representation for a different date and that the same may be directed to be considered.
5. It is seen that the Authorities, who are required to grant no objection certificate, had granted the same for the festival, which was scheduled to be conducted on 23.3.2018. However, it was the District Collector, who declined to grant permission.
6. Without going into the merits of the petitioner's claim, we dispose of the writ petition giving liberty to the petitioner to file a fresh representation along with a copy of this order and the no objection certificate given by the Authorities for the festival, which was scheduled to be conducted on 23.3.2018 and submit the same before the District Collector, who is, in turn, directed to consider the same on merits and in accordance with law, within a period of two weeks from the date of receipt
of such a fresh representation. No costs. Consequently, the connected WMP is closed.
