This writ petition has been under Article 226 of Constitution of Indiam to issue a writ of Certiorarified Mandamus, to call for the records in connection with the impugned proceeding in SCN/321468691/2025 dated 08.05.2025 passed by the 1st respondent and consequentially direct the 1st respondent to issue passport to the petitioner on the basis of the application in MA2067303950125.

ORDER

By consent of both the parties, the writ petition is taken up for final

disposal at the time of admission stage itself.

2. The Writ Petition has been filed seeking to quash the impugned proceeding dated 08.05.2025 passed by the 1st respondent and consequentially direct the 1st respondent to issue passport to the petitioner on the basis of the application in MA2067303950125.

3. It is the grievance of the petitioner that on 08.01.2025, the petitioner has applied before the respondents for issuance of passport and the same is pending. On 08.05.2025, the respondents issued show cause notice regarding the mismatch in place of birth particulars. The petitioner has appeared before the first respondent in response to the show cause notice. Despite which, the respondents are insisting upon production of a birth certificate for correction of place of birth. The petitioner do not have a birth certificate. Therefore, the petitioner's application is kept pending. Challenging the said show cause notice, the petitioner has filed the present writ petition.

4. The learned counsel for the petitioner submitted that pursuant to the show cause notice, the petitioner has given a suitable written reply and the same was received by the respondents. However, the petitioner's application is kept pending without taking any action. Hence, this Court may direct the respondents to consider the petitioner's reply and pass appropriate orders within the

stipulated time as fixed by this Court.

5. On the other hand, the learned Standing Counsel submitted that the first respondent will be considered the reply of the petitioner and appropriate orders will be passed on merits within the time frame to be fixed by this court.

6. Heard the learned counsel for the petitioner and the learned Government Counsel appearing on behalf of the respondents and perused the materials available on record.

7.Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this court without interfering with the impugned order, directs the first respondent to consider the petitioner's reply for the show cause notice and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The petitioner is directed to produce all the relevant document to the first respondent forthwith.

8.With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 06-03-2026 rli
