Writ petition No.6992 of 2018 filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondent to dispose of the petitioner's appeal dated 23.05.2012, 04.06.2012, 06.03.2012, 30.05.2012, 23.05.2012, 06.03.2012, 06.03.2012, 30.05.2012, 23.12.2011, 04.06.2012, 28.05.2012, 23.12.2011, 23.12.2011, 06.03.2012, 28.05.2012, 28.05.2012, 28.05.2012, 23.12.2011 & 06.03.2012 and representation dated 16.11.2016, 16.11.2016, 18.11.2016, 16.11.2016, 16.11.2016, 18.11.2016, 18.11.2016, 16.11.2016, 16.11.2016, 16.11.2016, 16.11.2016, 16.11.2016, 16.11.2016, 18.11.2016, 16.11.2016, 16.11.2016, 16.11.2016, 16.11.2015 & 18.11.2018 respectively and thereby direct the respondent to send the petitioner's appeal to the competent Court for

adjudicate the correct compensation and that of the order passed in W.P.No.29599 of 2017, dated 05.02.2018.

(in W.P.No.6992 of 2018) C O M M O N O R D E R Mr.Akhil Akbar Ali, learned Government Advocate, takes notice on behalf of the respondent. By consent, the Writ Petitions themselves are taken up for final disposal at the admission stage itself.

2. The petitioners have come forward with these Writ Petitions seeking direction to the respondent to dispose of the petitioner's respective appeals and the representations to send the appeal to the competent authority for adjudication.

3. According to the petitioners, their lands were acquired by the respondent for widening Old Mahabalipuram Road. An enquiry was conducted to ascertain the ownership, however, without proper enquiry compensation was fixed.

4. The grievance of the petitioners is that despite their representation and reminder, the matter was not sent to Court for proper adjudication.

5. Mr.A.R.Nixon, the learned counsel for the petitioners submitted that this Court, by an order dated 05.02.2018 in W.P.No.29599 of 2017, has directed the respondent to refer the matter to the Civil Court concerned under Section 20(1) of the Tamil Nadu High ways Act, 2001 for determination of compensation.

6. The learned Government Advocate appearing for the respondent submitted that the petitioners have not produced any proof for sending the representation and if any proof is submitted, they are ready to refer the matter.

7. The learned counsel for the petitioners, in reply, submitted that the petitioners are ready to produce the acknowledgment card before the respondent.

8. In light of the above facts and the submissions of the learned counsels on either side, the petitioners are directed to send a copy of the representation along with the acknowledgment card to the respondent within a period of two weeks, by enclosing a copy of this order. On such compliance, the respondent is directed to pass appropriate orders on the

representations / appeals of the petitioners, in the light of the order dated 05.02.2018 passed in W.P.No.29599 of 2017, within a period of eight weeks therefrom.

9. With the above observation and direction, the Writ Petitions are disposed of. No costs.
