This application is filed to condone the delay in filing the written statement of the 1st defendant.

2. Perusing the affidavit, this Court finds that the suit summons on the 1st defendant served on 12.12.2019. The limitation to file the written statement expired on 11.01.2020. The extension period of 90 days expired on 11.04.2020. However, in view of the pandemic situation, the Hon'ble Supreme Court, suo moto has passed an order in Writ Petition No.3 of 2020 issued moratorium for reckoning limitation from 15th March 2020 to 14.03.2021.

3. Considering the submission made by the applicant and the order passed by the Hon'ble Supreme Court regarding the period of limitation in the light of pandemic situation, the delay is condoned. The written statement of the 1st defendant is taken on file.
