ORDER

This criminal original petition is preferred seeking for a direction to the Superintendent of Police, Tiruvarur District, namely the first respondent herein, to appoint a new investigating officer and also to conduct reinvestigation of the case in respect of Crime No.915 of 2023 and also to file the charge sheet expeditiously.

2.The learned counsel for the petitioner and the learned Government Advocate (Criminal side) are before this court. 3.Earlier, when the matter has come before this court on 10.06.2026, this court finding that the concerned Inspector of Police was not before this court and also the Constable who appeared before this court on 10.06.2026 was unable to give any details with regard to the case, had directed the first respondent to ensure the presence of the Inspector of Police, second respondent, before this court in the next hearing date.

4.Today, when the matter is called, Mr.V.Murugaiyan, SSI of Thiruthuraipoondi police station has appeared and produced the final report dated 05.01.2024. A perusal of the same would show that the case has been closed as mistake of fact and notice has also been served in RCS No.1 of 2024. A copy of the postal receipt confirming the receipt of the notice and also a copy 2/5

of the certificate from the Village Administrative Officer, Mangudi, Thiruthuraipoondi for the service of the notice have been produced. It is also seen that though the RCS notice has been issued in the year 2024, it has been filed before the concerned court belatedly on 12.06.2026, i.e., after filing of this petition before this court on 25.02.2026.

5.In the light of the above, the petitioner is directed to file a protest petition before the learned Judicial Magistrate, Thiruthuraipoondi. The learned Judicial Magistrate, Thiruthuraipoondi is directed to take the referred charge sheet on file and also to receive the protest petition, if any, to be filed by the petitioner without citing any reason for delay in filing the protest petition and thereafter, dispose of the same on merits and in accordance with law.
