2. The Petitioners in this batch of Writ Petitions were amongst the 792 persons appointed as Village Administrative Officers after passing the Special Qualifying Test by relaxing certain rules subject to verification of their original certificates in furtherance to G.O. (Ms). No. 653, Revenue [(Ser-7(1)] Department dated 14.11.2008 issued by the Government of Tamil Nadu, and after they had joined duty, their services were regularized from the dates as per the particulars shown below:- Case No.

The Government of Tamil Nadu by G.O. (Ms) No. 90, Revenue [Ser. 7(1)] Department dated 22.02.2016 while directing regularization of their services had observed that the notional benefit should be given to them from the date of regularization and monetary benefits from the date of issue of that order.
3. The grievance ventilated by the Petitioners is that the monetary benefits also ought to be extended from the date of regularization instead of restricting it only from 22.02.2016. It is highlighted that though the Petitioners had been considered for appointment in the year 1980, their selection had been delayed and it was ultimately only in the year 2009 that they could actually join in service and many of them have also attained the age of superannuation by 22.02.2016, which denies them any effective relief of regularization.
4. Learned Counsel for the Petitioners strenuously pleads that when the Petitioners have actually worked during the relevant period, they could not be said to be at fault for the delay that has occurred in regularizing their service and it would not be fair or just to deprive them of the monetary
benefits that they are entitled to receive from the date of joining service.

It is submitted by Learned Advocate General referring to the Counter-Affidavit filed by the Respondents that it has been a policy decision of the Government to grant monetary benefits from the date of issue of the Governmental Order rather than from the date of their appointment taking into consideration the financial position of the Government and in such circumstances, the Petitioners ought not to be extended the monetary benefits from the date of joining duty as claimed by them.

Having regard to the rival submissions made, it is beyond cavil that the framing of administrative policy is within the exclusive realm of the Executive and its freedom to do so is, as a general rule, not interfered with by Courts unless the policy decision is 'demonstrably capricious or arbitrary and not informed by any reason whatsoever or it suffers from the vice of discrimination or infringes any statute or provisions of the Constitution'.
7. In the instant case, it is not in dispute that the Petitioners have attended their work during the relevant period and they have duly performed their duties. It is borne out from the record that the Petitioners had to knock the doors of the Court by way of Writ Petitions even for the benefit of regularization which they were legitimately entitled and they were not in any way responsible for that time taken. It must also not be lost sight that the payment of salary of the amount equivalent to that of a regular employee is a concomitant benefit that necessarily arises from regularization of service and the claim for differential salary made by the Petitioners cannot be said to be unjustified.
At this juncture, it would be useful to refer to the decision of the Hon'ble Supreme Court of India in State of Punjab -vs- Jagjit Singh [(2017) 1 SCC 148] where it has been observed as follows:- "58. In our considered view, it is fallacious to determine artificial parameters to deny fruits of labour. An employee engaged for the same work cannot be paid less than another who performs the same duties and responsibilities. Certainly not, in a welfare State. Such an action besides being demeaning, strikes at the very foundation of human dignity. Anyone, who is compelled to work at a lesser wage does not do so voluntarily. He does so to provide food and shelter to his family, at the cost of his self-respect and dignity, at the cost of his self-worth, and at the cost of his integrity.
lesser wage. Any act of paying less wages as compared to others similarly situate constitutes an act of exploitative enslavement, emerging out of a domineering position. Undoubtedly, the action is oppressive, suppressive and coercive, as it compels involuntary subjugation."
Viewed from this perspective, the financial implications cited by the State Government as the rationale behind its policy decision to deny the monetary benefits from the actual date of regularization till the date of passing orders for such regularization when the concerned employees have worked during the relevant period, is patently arbitrary and cannot be countenanced.

The result of the foregoing discussion is that the Petitioners are entitled to the monetary benefits from the date of their regularization and it shall be incumbent upon the Respondents to make payment of such differential amount due along with a working-sheet showing the calculation to the respective Petitioners under written acknowledgment and file a report of compliance by 31.07.2022 before the Registrar (Judicial) of this Court.
9. In the upshot, the Writ Petitions are ordered on the aforesaid terms. Consequently, the connected Miscellaneous Petitioners are closed. No costs.
