Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus, directing the respondents to disburse the interest to the petitioner at the rate of 8% for the belated disbursement of his Leave Encashment benefit for the period of 05/2018 amount along with the Leave Encashment benefit which he entitled for the period of 05/2019 with interest at the rate of 8% per annum from the said date of entitlement till the date of actual disbursement within a time limit to be stipulated by this Court.

This Writ Petition has been filed by the petitioner in the nature of a Mandamus, seeking a direction against the respondents to pay interest for the belated payment of his terminal benefit namely Encashment of Leaves. The petitioner had given a representation on 29.02.2024.

2. In the affidavit filed in support of the writ petition, it is stated that the petitioner was working as a Senior Trades man in the respondent Transport Corporation and retired from service upon attaining the age of superannuation on 30.04.2023. According to the petitioner, the terminal benefits were disbursed with a delay and he now seeks interest for the delayed period.

3. A direction is therefore issued to the respondents to examine the petitioner's Service Register and verify the date when the amount was disbursed. If it is found that the amount was disbursed with delay, interest at the rate of 6% per annum shall be granted from the date of retirement until the actual date of disbursement. The entire exercise shall be completed within a period of four months from the date of receipt 2/4

of a copy of this order.

4. With the above direction, this Writ Petition stands disposed of. No costs.
