O R D E R

The petitioner, who was arrested and remanded to judicial custody on 11.02.2026 for the alleged offence under Section 24(1) of COTPA r/w. Section 123 and 62 of BNS, in Crime No.58 of 2026 on the file of the respondent Police, seeks bail.

2. The allegation against the petitioner is that on 11.02.2026, when the police were on patrol, the petitioner was found in possession of 149.77 kgs of banned tobacco products in a car. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner was in possession of 149.77 kgs of Tobacco products and he was remanded to judicial custody on 11.02.2026. The learned counsel for the petitioner would further submit that the petitioner is innocent and has been falsely implicated in this case. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and undertakes not to tamper with the witnesses. Hence, he prayed for grant of bail.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner is having one previous case same in nature. He would further submit that if the petitioner is released on bail, he may abscond and tamper with witnesses and hence, he opposed the grant of bail. 2/4

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission made by the learned Government Advocate, the worth of the Tobacco products is Rs.70,000/- and the petitioner has got previous cases of similar nature. Having considered the submissions of the learned Government Advocate, this Court is of the view that it is not desirable to grant bail to the petitioner at this stage.
