Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying for the relief as stated therein to issue a WRIT OF HABEAS CORPUS directing the respondent to produce the body and person of the detenu by name MR.PRAVEEN son of MR.K.G.ARUMUGAM before this Honble court and set him at liberty now under illegal detention of the 2nd and 3rd respondent herein.

O R D E R

The petitioner, who is the father of the detenu, has filed this Habeas Corpus Petition seeking to direct the respondent-Police to produce the detenu, by name Praveen, son of K.G.Arumugam, aged 26 years, before this Court and to set him at liberty.

2. According to the petitioner, the detenu was married to one M.Logeshwari on 2.6.2014 and they were living happily. The grievance of the petitioner is that his son was found missing from 16.9.2014. In this connection, he had lodged a complaint before the respondentPolice, on 18.9.2014, and it had been registered as Crime No.1229/2014, on the file of the respondent-Police, as a man missing case. The petitioner suspects respondents 2 and 3, who are the parents of one Ayswariya, with whom the detenu had some sort of intimacy, before his marriage with M.Logeshwari. According to the petitioner, the detenu has been illegally detained by respondents 2 and 3, with an intention to get their daughter married to the detenu. https://hcservices.ecourts.gov.in/hcservices/

3. A status report, dated 4.3.2015, had been filed by the respondent-Police stating that numerous steps had been taken to trace the detenu, as well as the said Ayswariya. Further, the investigation reveals that it is a case of elopement, which was wellplanned. A reading of the status report reveals that the respondent-Police has taken all possible efforts to trace the detenu and the said Ayswariya. However, their whereabouts are not known till date. Still, the respondent-Police are continuing their investigation.

4. We are convinced that the respondent-Police are taking necessary steps to trace the detenu, as well as the said Ayswariya. Under such circumstances, we are of the view that no further orders are necessary in this petition. Hence, the Habeas Corpus Petition stands closed. However, we direct the respondent-Police to go ahead with the investigation and take appropriate steps to trace the detenu, as expeditiously as possible.
