Side) For Intervenor : MR.E.SATHYARAJ, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 294(b), 498-A & 506(i) of IPC in Crime No.Not Known of 2022 seeks anticipatory bail.
2. The petitioner herein married the defacto complainant on 07.11.2016. It is alleged that the petitioner is having illegal intimacy with one Hemalatha, when the defacto complainant questioned the same, the petitioner herein and his family members attacked her. It is further alleged that, earlier they have taken away her money and constructed a house at Avadi. Whenever she fought for her right, she used to be abused, attacked and her jewels were taken away by the petitioner for his illegal activity.
3. On perusing the FIR, this Court finds that the Police after making primary enquiry has found prima facie offence against the petitioner and registered FIR in Crime No.5 of 2022. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Government Advocate (Crl. Side) submits that the accused persons though summoned, they have not participated in the enquiry. Hence, he opposed for granting anticipatory bail to the petitioner.
5. In view of the above submissions made by the learned Government Advocate (Crl. Side), this Court is not inclined to grant anticipatory bail to the petitioner.
